1. Introduction
This Acceptable Use Policy ("AUP") governs the use of the Votrack election vote tracking platform and related services ("Services") provided by Votrack Inc. ("Votrack"). This AUP forms part of our Terms of Service.
2. Intended Use
Votrack is designed exclusively for lawful, independent parallel vote tallying and election tracking as permitted under Kenyan election observation and monitoring laws. The platform is intended for use by political campaigns, political parties, election observers, and authorized organizations during Kenyan elections.
3. Prohibited Activities
You may not use the Services to:
3.1 Election Integrity Violations
- Submit deliberately false, fabricated, or manipulated vote tallies
- Misrepresent Votrack data as official IEBC election results
- Use the platform to interfere with, disrupt, or undermine the electoral process
- Use election data collected through Votrack for voter intimidation or harassment
- Share access credentials with persons not authorized by your organization
3.2 Illegal Activities
- Conduct or facilitate any activity that violates the laws of Kenya or any applicable jurisdiction
- Use agent personal data (phone numbers, ID numbers) for purposes other than election tracking
- Violate data protection laws, including the Data Protection Act, 2019
- Engage in any form of election fraud or bribery
3.3 Unauthorized Access
- Attempt to access other subscribers' data, databases, or accounts
- Probe, scan, or test the vulnerability of the platform without authorization
- Bypass authentication, access controls, or security measures
- Access or use administrative features or APIs without proper authorization
- Share agent login credentials (phone numbers, PINs) with unauthorized persons
3.4 System Abuse
- Interfere with or disrupt the Services, servers, or networks
- Introduce malware, viruses, or other harmful code
- Conduct denial-of-service attacks or flood the platform with excessive requests
- Use automated scripts or bots to interact with the platform without authorization (USSD and Telegram bot interfaces are excluded from this restriction)
- Tamper with or reverse-engineer the platform software
4. Agent Conduct
Subscribers are responsible for ensuring their polling agents:
- Submit accurate vote tallies as read from the official Form 34A at their assigned polling station
- Upload genuine, unaltered Form 34A photographs
- Report incidents truthfully with accurate descriptions and genuine photo evidence
- Do not share their authentication credentials (phone number, ID number, USSD PIN) with others
- Do not submit results for polling stations they are not assigned to
5. System Resource Limits
To ensure fair usage and platform stability for all subscribers:
- API Requests: API usage is subject to rate limiting (60 requests per minute per instance)
- USSD Sessions: Limited to 30 requests per phone number per minute
- Photo Uploads: Form 34A and incident photos are limited to 10MB per image
- Data Exports: Large archive exports may be queued to prevent system overload
6. Reporting Violations
If you become aware of any violation of this AUP, please report it to:
Reports may be submitted anonymously. We investigate all reports and take appropriate action.
7. Enforcement
Violations of this AUP may result in:
- Warning and request to cease the prohibited activity
- Temporary suspension of access to the Services
- Permanent termination of your account
- Reporting to relevant authorities (IEBC, law enforcement) where applicable
- Legal action to recover damages
We reserve the right to take immediate action without prior notice in cases of serious violations that threaten the integrity of the electoral process or the platform.
